Under our “Duty of Care” we wish to bring to your attention that the annual testing of all Backflow devices and the repair and upkeep of Backflow Devices is mandatory under AS/NZ Standards 3500 and the Local Council and / or Water Boards Requirements and the Plumbing Code of Australia. Annual testing of the Backflow devices is no guarantee that the device/s will continue to operate in a satisfactory manner. Failure to have proper and working Backflow Protection in place may result in no Public Liability Insurance, no Workers Compensation Insurance and no building or property insurance. Also, should an incident occur Safework NSW (Workcover) and the coroner may be involved, along with NSW government penalties for gross negligence in the workplace. Under current Australian Standards and NSW Code of Practice (for Plumbers) all water downstream of an internal Backflow device is considered non-potable. ALL FAILED DEVICES MUST BE REPORTED TO THE WATER AUTHORITY.

Status of parties

Nothing in this Agreement shall create, or be deemed to create, a partnership or joint venture or relationship of employer and employee or principal and agent between the parties.
